In this conversation, Afrika Mhlophe sits down with Cause for Justice Executive Director, Ryan Smit, to unpack the ‘Gender ‘transition’ in schools case’ currently before the Cape Town High Court.
Introduction
At the centre of this case lies the question of how schools should respond when a learner wishes to be treated as if he/she was of the other sex/gender.
A high school boy expressed a desire to present himself and to be treated at school as if he was a girl. The school agreed to some accommodations but declined others – for example, access to girls’ bathrooms – which led to a complaint of unfair discrimination under the Equality Act.
The court is being asked to decide whether the school’s actions amounted to unfair discrimination. The school denies having acted wrongfully.
Cause for Justice has joined the case as an amicus curiae (friend of the court), with the role of assisting the judges in answering this question to reach a fair and just outcome to the dispute.
